Terms of Service

1. The Service

Aymam AI provides AI assistants run over WhatsApp and Telegram. They include generating images and videos from product photos, scheduling and publishing Instagram posts, replying to Instagram messages and reporting statistics (Instagram assistant), and watching security-camera footage, answering questions and sending alerts for defined situations (Komşu). Plan contents and quotas are stated at the time of order.

2. Accounts and Authorization

The Customer authorizes Aymam AI to access its Instagram, WhatsApp and other required accounts through Meta's official APIs. The assistant accepts commands only from the authorized phone numbers the Customer provides; the Customer is responsible for keeping those numbers secure.

The Customer is responsible for using its accounts in line with Meta's and other platforms' rules. A Customer connected with its own WhatsApp number pays Meta's messaging fees directly to Meta.

3. Customer Obligations

• Keeping the product, price, stock and FAQ information given to the assistant accurate and current.
• Holding the necessary rights to the photos, logos and content it sends.
• Not publishing unlawful or misleading content, or content that infringes third-party rights.
• Telling its own customers that their messages may be answered by an AI assistant, and meeting its own KVKK/GDPR obligations as the controller of its customers' data.
• For Komşu, being legally entitled to record the monitored area and providing the required notices and signage.

4. AI-Generated Content

AI output can contain mistakes. Aymam AI takes precautions, such as quoting prices only from data the Customer entered and passing uncertain questions to the Customer, but does not guarantee that output will always be correct. The Customer can switch on approval mode for posts at any time. The Customer is responsible for content published on its account and for replies caused by its own inaccurate data.

5. Fees and Payment

• For Customers in Turkey, prices are shown in Turkish lira including VAT (KDV).
• For Customers outside Turkey, prices are shown in US dollars or euros, without Turkish VAT. Any taxes arising in the Customer's country (for example EU reverse charge) are the Customer's responsibility.
• Subscriptions are paid monthly in advance and renew automatically unless cancelled. Payments are taken via [ÖDEME KURULUŞU / PAYMENT PROVIDER — e.g. Stripe] or bank transfer; invoices are issued electronically.
• The Customer may cancel at any time; cancellation takes effect at the end of the paid period. Subject to mandatory law, partial periods are not refunded.
• Price changes are announced at least 30 days in advance and apply from the next period.

6. Free Trial

The free trial is limited in time and quota (stated when the trial is offered). Content prepared during the trial is not published without Aymam AI's approval and is deleted when the trial ends.

7. Intellectual Property

Content the Customer sends, and images, videos and text generated for the Customer under the service, belong to the Customer. The Customer grants Aymam AI a license to use that content only to provide the service. Aymam AI may feature Customer content in its own marketing only with the Customer's written permission. All rights in the software, assistants and platform belong to Aymam AI.

8. Personal Data

Personal data is processed in line with the Privacy Policy and KVKK Information Notice. For data belonging to the Customer's own customers, the Customer is the controller and Aymam AI the processor: Aymam AI processes that data only on the Customer's instructions and to provide the service, applies appropriate security measures, and deletes it when the contract ends.

9. Availability and Third Parties

The service depends on third-party infrastructure such as Meta, Google and Amazon Web Services. Their outages, rule changes or API changes can affect the service; Aymam AI uses reasonable efforts but does not guarantee uninterrupted service.

10. Limitation of Liability

To the extent permitted by law, Aymam AI's total liability under these terms is limited to the fees the Customer paid in the 3 months before the event giving rise to the claim. Aymam AI is not liable for indirect losses such as lost profits, lost data or reputational harm. Liability for intent and gross negligence, and mandatory consumer rights, are unaffected.

11. Suspension and Termination

Aymam AI may suspend the service or terminate the contract for non-payment, breach of these terms or platform rules, or unlawful use. On termination, Customer data is deleted within the periods in the Privacy Policy.

12. Changes

These terms may be updated. Material changes are announced at least 30 days in advance by WhatsApp or e-mail. If the Customer does not accept them, it may end its subscription at the end of the period.

13. Governing Law and Jurisdiction

These terms are governed by Turkish law. The courts and enforcement offices of [İL / CITY] have jurisdiction. Consumers keep their right to apply to consumer arbitration committees and consumer courts.
